Employment Law

German Employment Law is known for its high standards of employee protection. This has many effects for employers and employees, be it regarding the employment contract, the course of the working relationship or its termination as well as possible court proceedings at the Labour Courts.

Unlike many other countries, there are strict limitations with respect to possible contents of employment contracts. Most employment contracts have several stipulations that are not valid. This is especially true for contracts that are published in the internet or spread by non-legal consultants. Especially for the employer this bears high risks as the German labour courts allocate financial risks rather with the employer than with the employee.

The legal situation has become even more complicated by a change in legislation which made the EU-regulatives regarding consumer protection towards standard terms and conditions generally applicable to employment contracts.
