No termination on the grounds of Airbnb-subletting
No termination without notice on the grounds of subletting the apartment to tourists without permission
LG Berlin, judgment of July 27, 2016 – 67 S 154/16 –
The regional court of Berlin ruled that a landlord may not terminate his tenant without notice in case the tenant sublet his flat to tourists, through the Website Airbnb, without his permission. The landlord must first give notice. Such a termination is only effective if the landlord first gave notice and the tenant continued with his action (Az. 67 S 154/16).
