Your Path to Germany – Two Options, Two Proven Routes

Route 1: Company Formation, Business Plan & Residence Permit for the Self-Employed

This is the classic route for entrepreneurs who want to build and run their own company in Germany.

If you want to found a company in Germany and bear the entrepreneurial responsibility as a majority shareholder or sole owner, you are considered self-employed under German law. On this basis, a residence permit can be applied for – for you, your spouse and your children.

The German authorities examine three key criteria:

  • Economic interest: Does your business idea bring genuine added value to the regional and German market? Does it create jobs, promote innovation or meet a regional need?
  • Positive impact on the economy: Your venture must strengthen the local or national economy – through investment, new technologies or the creation of employment.
  • Secured financing: You must demonstrate that the company and your living expenses – including those of your family – are soundly financed.

Once your business is up and running and your family’s livelihood is secured, you can apply for a permanent right of residence in Germany after just three years – a prospect that very few other immigration routes offer within this timeframe.

Route 2: Investor & Managing Director – Residence Permit in Other Shareholder Constellations

If you want to build your future business in Germany together with partners and you do not necessarily need to be a majority shareholder – or hold any shares at all – there is a second option available. Opting for a minority shareholding has the advantage that the relatively complex residence permit procedure for the self-employed does not apply. The residence permit can instead be applied for on the basis of employment as a managing director or senior executive – a process that is generally faster and more straightforward.

In such minority constellations, the employment-based visa for Germany can also be an interesting alternative. This route is suitable for skilled professionals with a recognised university or vocational qualification, as well as for managing directors, senior executives and highly qualified company specialists.

Those who hold a recognised or equivalent qualification and a concrete job offer can generally apply for a residence permit as a skilled worker. In suitable cases, the accelerated skilled worker procedure can be used to advance the process more quickly.

A university or vocational qualification is not always required, however. Managing directors, individuals in senior positions and company specialists with particular – especially company-specific – expertise can also obtain a residence permit for employment purposes. What matters is the specific position, professional experience, area of responsibility and the significance of the role for the German company.

The EU Blue Card can also be an attractive option. It is generally available to highly qualified employees with a corresponding job offer and may, under certain conditions, also be open to IT specialists without a university degree.

This route is particularly suitable for:

  • Skilled professionals with a recognised university or vocational qualification
  • Managing directors and senior executives
  • Company specialists with particular expertise
  • Highly qualified individuals with relevant professional experience
  • IT specialists – in some cases even without a university degree
  • Individuals wishing to take on a position of responsibility within a German company

However, all of these constellations come without the key advantages of Route 1: the company will not belong to you (alone), and you will in practice have to relinquish entrepreneurial control. There is also no possibility of applying for a permanent residence permit after just three years. It is also important to note that shareholder structures within the family tend to be viewed critically by the authorities, which can significantly complicate the procedure.
